Terms of Service

1. Definitions

• Platform / Service: Entales (accessible at https://ental.es), the SaaS online form builder platform operated by PIESE ROBOTICA COMPETII SRL.
• Operator: PIESE ROBOTICA COMPETII SRL, VAT RO45585673, registered at Str Principal 155D, Soimus, Romania.
• User: any natural or legal person who accesses or uses the Platform, whether or not they have created an account.
• Account: the personal account created by the User on the Platform, secured by email and password.
• Content: any data, forms, responses, texts, images or other materials uploaded or generated by the User through the Platform.
• Subscription: the pricing plan selected by the User for access to Platform features.

2. Service description

Entales is a SaaS (Software as a Service) platform for creating online forms through a drag & drop interface. The Platform allows Users to create, publish and manage professional forms, collect responses and analyze the data received.

The Service is provided exclusively in digital format. No physical components are delivered.

3. Plans and pricing

The Platform offers the following pricing plans:

Prices include VAT where applicable. The Operator reserves the right to modify prices, with at least 30 days prior notice to Users. Active subscriptions remain at the contracted price until the end of the current billing period.

4. User account

To use the Platform, the User must create an account by providing a valid email address and a password. The User is responsible for:

• Maintaining the confidentiality of their authentication credentials (email and password).
• All activities carried out through their account.
• Immediately notifying the Operator in the event of unauthorized access to their account.

The Operator is not responsible for losses caused by unauthorized use of the account, to the extent that the User has not taken reasonable security measures.

5. Acceptable use

The User agrees not to use the Platform for:

• Sending unsolicited commercial messages (spam) or phishing.
• Collecting personal data without a legal basis (without consent, without a contract, etc.).
• Distributing illegal, defamatory, obscene content, or content that incites violence or discrimination.
• Attempting to compromise the security of the Platform, other users or the infrastructure.
• Using the Platform for fraudulent or illegal activities.
• Reselling or sub-licensing access to the Platform without the written consent of the Operator.
• Exceeding rate limits or abusing the API in a manner that degrades service for others.

The Operator reserves the right to suspend or close accounts that violate these terms, without prior notice in serious cases.

6. Intellectual property

The Entales Platform, including its source code, design, brand, logo and documentation, are the exclusive property of PIESE ROBOTICA COMPETII SRL and are protected by copyright and intellectual property law.

Content created by the User (forms, collected responses, configurations) remains the User's property. The Operator does not claim ownership rights over User Content.

The Operator has a limited, non-exclusive right to process User Content solely for the purpose of providing the Service.

7. Limitation of liability

The Platform is provided "as is". The Operator makes reasonable efforts to ensure the availability and proper functioning of the Service, but does not guarantee:

• 100% uninterrupted availability (scheduled maintenance or technical incidents may occur).
• Complete absence of errors or vulnerabilities.
• Compatibility with all devices or browsers.

In no event shall the Operator's total liability to the User exceed the amount paid by the User in the last 12 months for the Service. This limitation does not apply to damages caused intentionally or through gross negligence.

8. Modification of terms

The Operator reserves the right to modify these Terms of Service. In the case of significant changes, Users will be notified via:

• Email to the address associated with the account, at least 30 days before the changes take effect.
• Visible notification in the Platform interface.

Continued use of the Service after the changes take effect constitutes acceptance of the new terms. If the User does not agree with the changes, they may terminate their account as described in section 9.

9. Account termination

By the User: The User may terminate their account at any time from the Platform settings. After termination:

• Access to premium features ceases at the end of the paid period.
• Account data is retained for 30 days to allow recovery, after which it is permanently deleted.
• Billing data is retained for 10 years in accordance with Romanian tax legislation.

By the Operator: The Operator may suspend or terminate the account in the following situations:

• Violation of the Terms of Service.
• Fraudulent or illegal activity.
• Non-payment of the subscription after a 14-day grace period.

10. Governing law and jurisdiction

These Terms of Service are governed by Romanian law. Any disputes shall be resolved by the competent courts of Romania.

For consumers in the European Union, the rights conferred by national consumer protection legislation remain fully applicable.
